You have a choice. Either fight the case all the way through trial or negotiate the best deal possible. The choice is yours. Obviously you would confer with your lawyer who would analyze the situation and give you his or her recommendation. But ultimately the choice is yours. Before going to trial, we may be able to pursue other means of stopping the prosecution by motions to suppress evidence or motions to dismiss because of some error made by the police in its investigation or arrest procedures.
