What is the penalty if I drive while my license is under suspension as a result of a DUI incident?

If you license is under suspension, do NOT drive! If you do, you could face a mandatory, minimum jail sentence of 30 days in jail (and it could be longer if this is not your first offense). This penalty applies whether your license has been suspended as a result of the Per Se program or of a conviction for DUI. The only way to beat the charge is to attack the stop and claim it was in violation of your constitutional rights, which is difficult to do. Or persuade the court that your case satisfies the criteria to avoid the mandatory, minimum jail sentence. You cannot drive at all (unless you get a work permit), including to the AEP classes. In most cases, you can delay the start of the AEP until you have your license back.
