What is the Statute of Limitations and Why is it Important?
A statute of limitations is the deadline date by which a lawsuit must be filed in court. There are different deadlines for different types of lawsuits. To find the correct deadline, you first have to determine what kind of lawsuit you are filing and then determine which statute applies to that type of claim. In Connecticut, every lawsuit is started by the filing of a complaint against the defendants. In state court cases, the complaint for the lawsuit must be in the hands of a Marshal for service on the defendants within the deadline established by the applicable statute of limitations or else the case will be thrown out of court and the injured person will not be able to recover any money. In federal court cases, the complaint must be filed in court before the statute of limitations expires or it will be thrown out of court.
If a statute of limitations is missed because a lawyer failed to bring the action in time, the injured person can bring an action for legal malpractice against the lawyer.
